Seller and author information

These Terms of Use govern the purchase of Moodle themes, plugins, and related digital products (“Products”) from Mariusz Bołoz - LmsStyle (“LmsStyle”, “we”, “us”, or “our”).

LmsStyle operates under the LmsStyle brand and the marketplace author name marbol2, selling digital products through the LmsStyle Store (powered by Lemon Squeezy infrastructure) and third-party marketplaces, including Moodle Marketplace and Envato Market (ThemeForest).

By purchasing any Product from LmsStyle, you agree to these Terms of Use.

Products may be purchased through different sales platforms. The terms and conditions of the platform through which a Product is purchased may also apply to the transaction, including payment processing, invoicing, refunds, and other platform-specific matters. In the event of a conflict between these Terms and mandatory terms of the applicable sales platform, the applicable platform terms shall govern the relevant transaction to the extent of the conflict.

Products

LmsStyle develops and sells digital products, such as:

  • Moodle themes
  • Moodle plugins
  • Related digital products and services

All Products are delivered electronically and require a compatible Moodle installation.

Product licensing

Components of LmsStyle Moodle themes and plugins that are derived from or integrated with Moodle are licensed under the GNU General Public License (GPL), in accordance with Moodle licensing requirements.

Where GPL applies, your rights to use, modify, and redistribute those components are governed entirely by the GPL.

This commercial license permits you to use these components solely as part of the Product within the number of end-user Moodle installations permitted by the applicable license purchased, including multiple installations on subdomains where expressly permitted by the applicable license, unless otherwise stated on the applicable Product page.

Most licenses permit use on a single Moodle installation. Multiple installations on subdomains are permitted only under licenses that expressly include this option, such as the applicable University license.

For example, a license that permits unlimited installations on subdomains may be used for separate Moodle installations hosted on subdomains of a single main domain, such as different university faculties, departments, or other units of the same institution:

Allowed - all installations use the same main domain:

  • arts.example.com
  • engineering.example.com
  • law.example.com

Not allowed - installations use different main domains:

  • arts.example.com
  • engineering.example.org
  • law.example.net

The domain extension (such as .com, .org, or .edu) is not relevant. What matters is that all installations are hosted on subdomains of the same main domain.

All installations must be operated by the licensed institution and use subdomains of the same main domain. The license does not permit installations on multiple unrelated main domains, even if those domains are owned or operated by the same institution.

Nothing in these Terms is intended to restrict any rights granted to you under the GPL. Where applicable, the GPL shall take precedence over these Terms.

License limits and Active Learners

Some Products may be subject to license limits based on the number of Active Learners, installations, or other usage limits specified on the applicable Product page.

Active Learners means unique learner accounts that are currently enrolled in at least one active course on the Moodle site.

A learner is counted only once, regardless of the number of active courses in which they are enrolled.

Users who are not learners, such as administrators, teachers, managers, and other staff accounts, are not included in the Active Learner count.

Registered user accounts that are not enrolled in any active course are not included in the Active Learner count.

For the purposes of these Terms, a course is considered active if its start date has passed and its end date has not yet passed, as configured in Moodle. If no start date or end date is set and the course is not hidden, the course is considered active indefinitely for the purpose of determining the number of Active Learners.

The applicable Active Learner limit is determined by the license purchased and is specified on the relevant Product page at the time of purchase.

Customers are responsible for ensuring that their use of the Product remains within the applicable license limits.

Acceptable use

You agree not to:

  • Use our website or Products in any way that violates applicable laws or infringes the rights of others.
  • Try to access systems, accounts, or data that do not belong to you or for which you do not have authorization.
  • Scan, probe, or test the security or vulnerabilities of our infrastructure without prior written permission.
  • Disrupt, interfere with, or negatively impact the normal operation of our website, services, or Products.
  • Sell, share, or distribute any part of the Products unless this is explicitly allowed under your license or applicable open-source licenses (including the GNU General Public License (GPL), where applicable).
  • Use the LmsStyle name, branding, trademarks, or product identity in a way that may suggest endorsement, affiliation, or official involvement where none exists.

Pricing and payment

All prices are displayed in the currency shown at checkout. Applicable taxes may be added where required by law. Full payment must be received before access to the Product is granted. We reserve the right to change pricing at any time, but such changes will not affect completed purchases.

Accepted payment methods are displayed during checkout and may be processed by the applicable sales platform or its payment providers, including the LmsStyle Store (powered by Lemon Squeezy), Moodle Marketplace, or Envato Market.

Digital delivery

Products are delivered electronically through the applicable sales platform after successful payment.

The method and timing of delivery or access may vary depending on the sales platform. Delivery or access is typically provided immediately or within a reasonable period after successful payment, although occasional delays may occur due to technical or platform-related issues.

Customers are responsible for:

  • Maintaining access to their account.
  • Downloading Products promptly.
  • Keeping backup copies of purchased files.
  • Ensuring compatibility with their Moodle environment.

Updates

Where updates are included with the purchase:

  • Updates may include bug fixes, security patches, new features, performance enhancements, and compatibility improvements.
  • Access to updates and future Moodle compatibility depends on the purchase platform. Purchases made through the LmsStyle Store or Moodle Marketplace include compatibility updates for future Moodle versions. For purchases made through Envato Market, compatibility updates will be provided up to and including Moodle 5.3 (LTS). Compatibility updates for Moodle versions released after Moodle 5.3 (LTS) will not be included with Envato Market purchases.
  • As Moodle continues to evolve, we may discontinue support for older Moodle versions.

Update schedules are provided at our discretion and are not guaranteed.

Technical support

Where support is included with your purchase, it may cover:

  • Access to product-related technical support during the active support period.
  • Technical assistance with the Product's built-in features and functionality.
  • Guidance regarding supported third-party components included with the Product.
  • Investigation of reported bugs, defects, and technical issues.
  • Bug fixes necessary to ensure the Product functions as described.
  • Security updates addressing significant vulnerabilities.
  • Compatibility and maintenance updates provided at our discretion.

Support does not include, unless explicitly stated on the Product page:

  • Customizing, modifying, or extending the Product beyond its original features and functionality.
  • Installation, configuration, or initial setup of the Product on your Moodle site.
  • Hosting services, server administration, or assistance with your hosting environment.
  • Support for third-party software, plugins, libraries, or services that are not part of the Product.

If you require custom development or implementation services, you are welcome to contact LmsStyle to discuss your requirements. Such services may be available separately for an additional fee.

Response times are measured during our business hours (Monday–Friday, CET/CEST, excluding public holidays).

Compatibility

We make reasonable efforts to ensure compatibility with the Moodle versions listed on each Product page.

However, we do not guarantee compatibility with:

  • Unsupported Moodle versions.
  • Customized Moodle installations.
  • Third-party plugins.
  • Third-party themes.
  • Custom code modifications.

Customers are encouraged to test Products in a staging environment before deploying them to production systems.

Refund policy

Refunds for Products purchased through a third-party sales platform are subject to the refund procedures and applicable terms of that platform, in addition to any rights provided by applicable law.

Because our Products are digital goods delivered electronically, refunds are generally not available once access to the Product has been granted, except where a refund is required by applicable law or the applicable sales platform’s terms.

Refunds may be granted only when:

  • The Product contains a reproducible defect that substantially prevents its intended use.
  • We are unable to provide a reasonable fix or workaround.
  • A refund is required by applicable consumer protection laws.

Refund requests submitted directly to LmsStyle should be made within 14 days of purchase, unless a different period applies under applicable law or the terms of the sales platform through which the Product was purchased.

We reserve the right to deny refund requests where:

  • The Product functions as described.
  • Compatibility issues arise from unsupported environments.
  • The customer changes their mind after purchase.
  • The issue results from third-party modifications or software.

Intellectual property

While certain components of Moodle themes and plugins are distributed under the GPL:

The LmsStyle name, branding, logos, graphics, website design, screenshots, documentation, and marketing materials remain the intellectual property of Mariusz Bołoz - LmsStyle. No trademark rights are granted through any Product purchase.

Customers may not represent themselves as LmsStyle or marbol2.

Customer responsibilities

Customers are responsible for:

  • Maintaining secure backups.
  • Testing the software before deployment.
  • Ensuring compliance with applicable local laws and regulations.
  • Keeping their Moodle installation up to date and secure.

Customers acknowledge that software may contain unforeseen bugs despite testing and quality assurance efforts.

Disclaimer of warranties

To the fullest extent permitted by law, all Products are provided on an “as is” and “as available” basis.

LmsStyle makes no warranties, express or implied, including but not limited to warranties of:

  • Merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Continuous availability.
  • Error-free operation.

We do not guarantee that Products will meet every customer requirement.

Limitation of liability

To the maximum extent permitted by applicable law:

LmsStyle shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. This includes loss of profits, loss of revenue, loss of data, business interruption, or reputational harm.

Our total liability arising from any claim relating to a Product shall not exceed the amount paid by the customer for that Product.

Suspension and termination

We reserve the right to suspend or terminate access to support services if:

  • Fraudulent activity is suspected.
  • Abuse of support services occurs.
  • Payment disputes or chargebacks are initiated.
  • These Terms are violated.

Termination of support services does not affect rights granted under the GPL.

Governing law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Poland, without regard to conflict of law principles.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Changes to these terms

We reserve the right to update or modify these Terms of Use at any time.

Changes become effective upon publication on our website and apply to purchases made after the publication date.
